  1.              Now its time "For the Rest of the Story"

  3. Many of the ChessMAGIC! customers have been asking me for my side of the
  4. story in the dispute with Tom Brady/Decibel BBS. I've been hesitant to
  5. discuss this publically, but due to the request of customers and potential
  6. customers, I'm making this information available for your viewing. I'm not
  7. going to sit back and let Mr. Brady continue with his malicious actions
  8. without a response.  
  9.  
  10. I've nothing to hide and will provide as much information as I possibly can.
  11. Anyone logging onto my BBS can view this bulletin.
  12.  
  13. Unlike Mr. Brady's derogatory bulletins that are NOT displayed to everyone 
  14. that access his BBS. They appear to only be displayed to those that are 
  15. "sysops" which would be potential purchasers of ChessMAGIC! or existing
  16. customers, as the old distribution archives provide Decibel BBS as the 
  17. contact/support BBS.  Local users have never seen such bulletins. Also it 
  18. must be noted that he has locked out some registered ChessMAGIC! customers 
  19. from his BBS. I'm offering a REWARD for anyone that will provide me with
  20. a copy of the bulletin(s).
  21.  
  22. Termination Services
  23. =======================
  24. First of all, I terminated Mr. Brady's services for a variety of reasons.
  25. He never left the association on his own, it was entirely my decision! I 
  26. will discuss the many reasons for my decision to eliminate Mr. Brady and 
  27. his services from the ChessMAGIC!/KnightWare products.
  28.  
  29. Reasons for Termination
  30. =======================
  31.  1) CMSED  - System Editor written by T. Brady using FoxPro
  32.  
  33.     My intentions with CMSYS was to make this part of the ChessMAGIC!
  34.     registration, not to be sold separately. Mr. Brady had persuaded me
  35.     into limiting CMSYS so that CMSED would be the main system editor
  36.     for ChessMAGIC!. At this time, I did not know his intentions, but
  37.     found out quickly from one of my customers. At this time, CMSED was
  38.     suppose to be in whole a part of the ChessMAGIC! registration. Mr.
  39.     Brady, behind my back, started requesting separate registration fees for
  40.     CMSED, limiting the functionality in releases to registered ChessMAGIC!
  41.     customers. After confronting Mr. Brady with this situation, he first
  42.     stated he was a third party software developer and could do anything
  43.     he liked. I kindly reminded him that I could easily modify ChessMAGIC!
  44.     that would make CMSED worthless. Then he took the position that he was 
  45.     just testing the marketablity of CMSED before informing me about. He 
  46.     denied behemently that he was trying to keep anything from me. I only 
  47.     continued with his services at this time, because I was not in the 
  48.     situation of starting a BBS. To add injury to insult, he also only 
  49.     wanted to provide me with a miniscule portion of the CMSED sales. He
  50.     stated I did not have anything to do with CMSED so why should he provide
  51.     me with a percentage that was comparable to what I was providing him
  52.     for ChessMAGIC!. I then had to remind him, that I permitted him to 
  53.     to distribute CMSED as the main editor and also kept ChessMAGIC!
  54.     compatible with it and that this situation could change easily.
  55.     As of this date, I have never received any proceeds coming from the 
  56.     sales of CMSED.
  57.  
  58.  2) ChessMAGIC! Support Conferences on Decibel
  59.  
  60.     Mr. Brady would not provide me any of the communications from my
  61.     customers. I only received the information that was directly addressed
  62.     to my BBS name and its highly likely that much of it was censored by  
  63.     Mr. Brady. I requested this information many times from Mr. Brady,
  64.     and he would always have some sort of excuse for not providing me with
  65.     this information. He intentionally buffered the information from me,
  66.     in an effort to lock him and his BBS in the association. Finally he
  67.     set the conference up for my access, but first removed all the previous
  68.     comminications from it! One customer had uploaded a file, containing
  69.     the Canadian algorithmns for rating calculations, for me to incorporate
  70.     into ChessMAGIC!. Mr. Brady deemed that it was not necessary for this
  71.     to go into the product and would not provide the file to me. Mr. Brady
  72.     never did have the "say so" of what went into the product. It is
  73.     inexcusable to buffer such information from the author of the product.

  75.  3) Developement Testing/QA files
  76.  
  77.     Mr. Brady was to provide me with the ChessMAGIC! game data base from
  78.     his BBS weekly. When he did provide it, and it was sparse, he only
  79.     provided portions that he decided were necessary. This handicapped
  80.     developement testing/debugging severly.
  81.     
  82.  4) Theft!
  83.  
  84.     Mr. Brady has witheld registration money and customer information
  85.     from me, since March 1992. I have not received a penny from any 
  86.     registrations going through Decibel from March 1992. I also have
  87.     not been provided customer information pertaining to these sales.
  88.     Mr. Brady has never provided me a reason as to why he decided to
  89.     retain monies and information which are due to myself. If you ever
  90.     hear Mr. Brady denying this, the "proof's in the pudding", I have
  91.     customers that have surfaced proving this!
  92.  
  93.  5) Last Release to Decibel
  94.  
  95.     I provided Mr. Brady the means to register ChessMAGIC! for customers.
  96.     He provided the credit card registrations, then was suppose to disburse
  97.     the percentage of the sale that was due to myself. In the last release 
  98.     I provided him, in an effort to rectify the situation in 4 above, I 
  99.     altered the registration scheme, so that only myself could issue r
  100.     egistered ChessMAGIC! products. Mr Brady never put this release on his 
  101.     BBS or made it available. He always complained about it having a bug, 
  102.     but would never provide me the information about the bug. He saw that 
  103.     he would lose control of the registrations and was going to do his 
  104.     darndest to keep that capability in his control. I could no longer 
  105.     "afford" for Mr. Brady to supply registered copies as he decided to 
  106.     pocket the entire proceeds for himself.
  107.  
  108.  6) After all of the above, I provided Mr. Brady 30 days to respond 
  109.     in providing me the money and customer information due, issuing the
  110.     new release, and providing me the customer conference exchange
  111.     of information. Mr. Brady never responded and I have "never" 
  112.     received any of the above!

  114.  7) On two different occaisions, Mr. Brady told me that if I dropped
  115.     his services, he would "kill ChessMAGIC!". I could no longer tolerate
  116.     his threats or his coersive actions in this association, so his services 
  117.     were terminated!

  119.  
  120. Malicious Allegations
  121. =======================
  122. Mr. Brady has made some vocal allegations in an effort to "kill ChessMAGIC!"
  123. as he stated he would do. He has contacted customers by voice phone, and
  124. has posted malicious messages on his BBS. Mr. Brady is vindictive,
  125. and this can be substantiated by several of his BBS users. He is attempting 
  126. to punish me for dropping his services. The only person Mr. Brady is 
  127. punishing, is himself.

  129.  Some of Mr. Brady's Allegations
  130.  
  131.  1) I'm not the author of ChessMAGIC!
  132.  
  133.     I can assure you all the code in ChessMAGIC! was written by me,
  134.     except for purchased libraries. All the source code is and has
  135.     always been in my possession.
  136.  
  137.  2) I don't have the capabilities to write such a program
  138.  
  139.     This particular rumor is being verbalized from not only
  140.     Tom Brady, but B.H. Forbes as well.
  141.  
  142.     Simply amazing, somebody is coding it. I have over 14 years 
  143.     of experience in designing, developing and coding major 
  144.     applications.

  146.  3) Backdoors are built into the program
  147.  
  148.     This one baffled me. I have no reason whatsoever to
  149.     place a back door in ChessMAGIC!. This is a total fraudulant 
  150.     fabrication on Mr. Brady's part. Nothing more than a lie in an 
  151.     attempt to discredit the product and myself. 
  152.  
  153.  4) Portions of the code were pirated
  154.  
  155.     He's referring to the computer play code. I obtained this code
  156.     several years back, and it clearly states that it could be
  157.     used for anyone's purpose. There was no extensive documentation,
  158.     just source code. I have removed it just to dispell any rumors.
  159.     As I stated before, if I stepped on anyone's feet by using the
  160.     code, I apopologize for it. There was no intent on my part to
  161.     "pirate" anyone else's software. If I have infringed, it was
  162.     totally unintentional and has since been corrected.

  164.     Mr. Brady knew about this code from ChessMAGIC!'s inception,
  165.     and knew that it was removed before his termination.

  168. Brady's Bandwagon
  169. =================
  170. Mr. Brady has been communicating with B.H. Forbes, the purchased/author
  171. of BBS Chess. I've heard much of the same comments from ChessMAGIC! 
  172. customers, that were initiated by Mr. Brady now being communicated by 
  173. B.H. Forbes. If I were Mr. Forbes I would beware, because while my 
  174. association with Decibel was in effect, he slammed BBS Chess quite a bit. 
  175. Why the big turn around?  Just be careful!

  178. ChessMAGIC! vs BBS Chess
  179. ========================
  180. I might as well throw my 2 cents worth about this as well while I'm up on
  181. my soap box. There are rumors that Mr. Forbes is planning on initiating
  182. a copyright infringement suit against me. Mr. Forbes doesn't own the rights 
  183. to the "public domain" game of chess, nor the processes that are required 
  184. to play a game of chess, nor the output of statistical data produced by 
  185. chess competition. If so, the USCF, FIDE, CompuServe, USA Today and other 
  186. chess organizations and programs are in big trouble! Anyone can sue anyone 
  187. for anything, but to win it you must be correct in your cause.

  189. What Mr. Forbes doesn't like is the competition. Well the competition is
  190. not going away, it's just going to get better! For many years, his was the
  191. only viable product available. Now ChessMAGIC!'s arrived and is making an
  192. impact. Competition provides benefits for all, especially the user base.
  193. By creating a competitive market, it requires the developers to put out the
  194. best product available, which in turn, the users reap the rewards. The
  195. public can ill afford "monopolies" as products become stagnant with little
  196. incentive for improvements. Mr. Forbes produces a good product, but so
  197. do I and the public will decide which one they prefer. Some will like mine,
  198. some his, that's the concept of "free enterprise" in a nutshell.

  202. ChessMAGIC! Lives!
  203. ===========================
  204. I've made a strong commitment to the on going success of this product as  
  205. you can clearly see with my support BBS, Atlanta Chess, and the
  206. new releases and enhancements that are continuing. I have enjoyed
  207. developing this product and will continue to do so, long into the
  208. future. I truly appreciate everyone's support!

  210. The new computer play module, which I've named "Solo" (c)1992 KnightWare, 
  211. is well under construction. This module can be intergrated into ChessMAGIC! 
  212. or utilized as a standalone door program. The first release is will be
  213. Dec 22, 1992. Its currently running on my BBS. This product will provide
  214. unlimited nodes and anyone registering before Feb 1, 1993 with 1 year
  215. free support and updates!

  220. REWARD

  222. Anyone furnishing me any of the derogatory bulletins that were displayed 
  223. on Decibel, I will work something out for you in the terms of free 
  224. registrations or some nice upgrades to your existing KnightWare products.
